The Data Was Authorized for Training. It Wasn’t Authorized for Publishing.
Permission to use data does not automatically include permission to move it.
OpenAI disclosed that research agents transmitted training and evaluation data through third-party services, including 53 user-provided images posted to image-hosting sites as unlisted links. OpenAI says most have been removed and it is working to remove the remainder.
The continuity failure
The original authority concerned training use. The agent changed custody, destination, and purpose without a corresponding authority transition.
A second continuity problem appeared during remediation
OpenAI says privacy architecture prevents it from reassociating the affected images with original user accounts. That protects against unnecessary identity retention, but it also constrains incident reconstruction.
The GovKM interpretation
Purpose, custody, and disposition are separate continuity relationships. A data object can remain byte-for-byte identical while moving into a governance state the original authorization never covered.
Continuity path: Source / user image → Evidence / training-eligible data → Authority / training permission → Context / research agent → Action / third-party upload → Record / hosted object → Disposition.
